Alfresco Dining in Conjunction with Liquor licenses

How to Apply for an Alfresco Dining License

Any business that prepares and/or sells food, that is adjoining Public land may apply for an Alfresco Dining License to use a portion of that Public land to place Tables & Chairs, for their customers use. 

An application form must be completed, and submitted with a plan of the proposed area to be used, along with a copy of the business Public Liability Indemnity Insurance cover, to a value of cover of not less than $500,000, and should be accompanied by the appropriate fee, as prescribed. 

All applications that do not meet the criteria of the Policy must be referred to the appropriate Community Board
Such applications should be accompanied by the appropriate, increased fee, as prescribed in the fees.

The application should be submitted to the Environmental Services Department at Kaikohe.

Renewal of License

An Alfresco Dining License is renewable annually, on the 1st July of each year.
A renewal notice will be sent out to Council prior to that date.
Applicants wishing to make changes to the current license should do so by providing a revised plan, detailing either a reduction or increase in the area they wish to occupy, along with new, appropriate fee. 
The application will be checked against the Policy criteria, and if complying a new license will be issued, or the applicant notified to the contrary.

Change of Ownership

Should a premises change ownership the new owners will be required to complete a new application form
If they have an agreement with the vendor to take over the Alfresco Dining license, and do not intend to alter the licensed area, an amended license may be issued in the new owners name. 
If, however, the current license has been relinquished, a new application must be made, as per Application for a new license

Alfresco Dining in Conjunction with Liquor licenses

When applying for an Alfresco Dining license for a premises that has a current Liquor On-license it will also be necessary for an application to be made to vary the Liquor license, to incorporate the area required for the Alfresco Dining license, into the Liquor licensed designated area. 

For this it will be necessary to apply to the District Liquor Licensing Agency for a variation to the On-license.

At no time should alcohol be served or brought to any tables and chairs associated with Alfresco Dining in a Public Place, before a Liquor Licence, or a redefinition of an existing licence, covering the Alfresco Dining area, has been issued.
