Kerikeri-Waipapa Structure PlanAs a significant milestone, Council adopted the Kerikeri-Waipapa Structure Plan on 13 September 2007 after almost a year of public meetings, focus groups, media statements and publications designed to present planning options to the communities and encourage them to have a say in their future.
SCP (Special Consultative Procedure)Under the Local Government Act 2002, Section 83, Council is required to undertake the Special Consultative Procedure. View the Local Government Act 2002 online at http://rangi.knowledge-basket.co.nz/gpacts/public/text/2002/an/084.html The Structure Plan underwent a long process of initial consultation, by way of Open Forums and Focus Group meetings. From these meetings a Draft Kerikeri-Waipapa Structure Plan was released for the SCP. The SCP commenced on 18 June 2007 with submissions closing on 18 July 2007. There were 362 submissions received, making 1108 individual points. Some 137 submitters also took the opportunity to put their points directly to councillors during four days of hearings on the draft Plan. On the 23 August 2007 Council, after all the submissions had been considered, deliberated on the draft Plan. The council is now responding individually to everyone who made a submission, giving each one the attention it warrants. We are trying to get back to people as soon as we can, but given the volume and technical nature of some of the submissions we want to make sure we are responding with the level of detail they deserve. Where to from Here?The Structure Plan is a very broad direction setting document that proposes a number of studies, work and changes that will drive the area in an agreed direction. Before rezoning in the District Plan can be done, the Council needs to follow an information gathering process set out in the Resource Management Act (RMA). Once the Council has the required RMA information at hand, and has followed the prescribed consultation process, then the Council may change the zonings in the District Plan. All affected land owners will be notified at the start of the Plan Change process. Summary of Structure Plan Process: Development through ImplementationNow that Council has adopted the Structure Plan the implementation process will be reflected through the mechanisms in the table below. These methods of implementation involve formal statutory processes. In this respect there will be further opportunities for the community to be involved in the specific elements of implementation.
Summary of Plan Change Implementation ProcessUnder the Resource Management Act (1991) any process to change the District Plan requires all parties affected by the proposed change, including all land owners and occupiers who own the land subject to change, to be provided with an opportunity to make a formal submission or comment on the changes and specific rules/methods being proposed.
