Stalls and mobile businesses

To operate a mobile shop, hawker, tour operator, alfresco dining or set up a stall in a public place in the Far North District, you will need to apply for approval.

Definitions

  • mobile shop operates for short periods in one location before moving on, e.g. an ice cream van.
  • hawker offers goods for sale, sometimes on foot, without prior invitation to visit that private or public place.
  • stall is a specific location where a business is set up for more than 30 minutes e.g. on the roadside.
  • tour operator offers tourist activities in a specific site in a public place.
  • Alfresco dining enables the private use of public space for outdoor dining.

You may also need to register as a food business if you intend to sell food.  Please see our Food Registration information on the following page.

Step 1. Complete form

To trade in public or set up a stall, please download and fill in the application.

Step 2. Return to Council

Please return the form to Council by post, in person or by email.

Alternatively, the form can be returned to any of Council’s Offices or Service Centers.

Step 3. Department referral

Your application will be referred to the following areas of Council:

  • Roading Department - to assess any impact on traffic safety.
  • Parks Department - where parks or reserves are affected.
  • In some instances applications may be referred to the relevant Community Board for comment.

Step 4. Trade on a State Highway

To trade within a speed limit exceeding 50km/hr along a state highway, you must apply for approval directly with Waka Kotahi (NZTA).

Applications to Waka Kotahi can be made at https://www.nzta.govt.nz/resources/roadside-vendors-in-the-state-highway-corridor/.

You do not need approval if you intend to set up a food stall for:

  • A one-off event
  • Fundraising purposes (maximum of 20 fundraising events per year).

You will need to provide notification of your food stall for assessment.

Step 3.Issue exemption

If you meet the exemption criteria, you will be issued with a Certificate of Exemption for your food stall.
